General Sales Terms

 

The present sales terms are agreed between the company Brun de Vian-Tiran, here below named «Brun de Vian-Tiran» (2 Cours Victor Hugo, 84800 Isle-sur-Sorgue, RCS Avignon 56B63) and the purchasers, here below named “customers” who are purchasing goods on the website: www.brundeviantiran.com .

 

The present sales terms aim at defining the conditions of a transaction between Brun de Vian-Tiran and the customer, from the order to the delivery, via the payment and other services provided by Brun de Vian-Tiran.

 

These sales terms apply to the products present on this website at the date of the order.

 

Order

The customer declares that he or she has the age of majority in his/her country of residence and/or has the right to purchase goods by himself/herself on internet.

By ticking “I accept”, he/she declares to have read, understood and fully accepted these general sales terms.

The photos and drawings on this website are only given as information. Brun de Vian-Tiran is not responsible for differences in perception, shapes, colours…

The date of the order is:

- For an on-line payment by credit card: the date of validation of the order by the customer.

- For a differed payment (cheque, etc), the date of reception of the cheque (or other mean of

  payment).

Any order above € 1500 including tax will lead to a direct contact between Brun de Vian-Tiran and the customer in order to finalize the transaction; it will only be considered as valid after such finalization.

 

Prices

Prices are in Euro, tax included, without transportation charges.

The VAT applied is 19.6%.

An obvious mistake in writing a price may be corrected by Brun de Vian-Tiran.

 

To place an order

The customer must go to the website www.brundeviantiran.com

His identification must at least contain:

- His login and password if already given, otherwise by filling the questionnaire for on-line subscription.

- The products, sizes, colours and quantities ordered.

- The data necessary for the delivery.

- The type of payment mean.

Brun de Vian-Tiran being a French company located in France, the act of purchasing its goods on this website shall be considered as taking place in France.

Products Availability

Products are available unless sold out. Brun de Vian-Tiran will do its best to inform the customer in a short time of the unavailability of a product.

Order Confirmation

An email is automatically sent to the customer to confirm the reception of the order, as long as the email address provided by the customer is valid. This is not an order confirmation, as further checking may be necessary.

 

Order Cancellation After Goods Reception

 

According to the article L121-20 of the French Code de la Consommation, the customer has 7 days after the reception of the goods to cancel his order without giving a reason nor paying penalties except, possibly, the cost of returning the goods. According to the article L121-20-1 of the Code de la Consommation, Brun de Vian-Tiran must then reimburse the customer without delay, at the latest 30 days after the cancellation of the order.

 

Payment

 

Payment can be made by credit card, the type of which are defined by the payment system to which Brun de Vian-Tiran sub-contracts.

It also can be made by cheque, at the attention of Brun de Vian-Tiran.

The customer certifies that he/she owns the right to proceed to the payment.

Brun de Vian-Tiran ensures all due diligence in ensuring the security and the confidentiality of the information exchanged online.

In case of credit card refusal by the bank, cheque refusal etc… the customer must get in touch with Brun de Vian-Tiran to find a solution.

 

Invoice

 

The order bill of the order confirmation is not an invoice. The customer will receive the original invoice together with the delivered goods.

Brun de Vian-Tiran will keep of each invoice.

Property transfer

Brun de Vian-Tiran remains the owner of the goods until the payment of the customer has been fully completed. From the delivery to the customer, the last will be responsible for damages or loss.

 

Delivery

Orders received on the website are regularly checked and processed. Working days do not include week-ends and non-working days. No delay penalties shall be paid.

In case of shortage on some items, Brun de Vian-Tiran may have to send an order in several times. A solution may have to be found between the parties, without any penalties for shortage.

 

Packaging: the packaging is adapted to the transportation of the goods. The customer must also do the same in case of order cancellation and shipment back to Brun de Vian-Tiran.

 

Legal warranty: the responsibility of Brun de Vian-Tiran does not go beyond the replacement of the goods or the reimbursement of the amount paid, whenever a good is recognized as defective.

 

Force majeure: Brun de Vian-Tiran is not responsible for events resulting from Act of God, riots, civil commotions and act of war.

 

Brun de Vian-Tiran is not responsible for an improper use of the goods. In order to know the proper use and care of the goods, please refer to our website and/or contact us.

 

Signature, Data protection

All customers must subscribe and obtain an entry name and a password. These data are personal. In case of loss, the customer must inform Brun de Vian-Tiran.

 

In any case, receiving an order with credit card data and personal data of the customer will generate a valid order for Brun de Vian-Tiran.

 

Intellectual Property

 

All the content of the website www.brundeviantiran.com , including images, text, sound, are protected by the law on intellectual property. They are the exclusive property of Brun de Vian-Tiran.

The valid conditions are those at the time of the order confirmation by Brun de Vian-Tiran.
